Please read these Terms of Services (“Terms”, “Terms of Services”) carefully before proceeding to use our Services provided on VixuriousDesigns.com, which is operated by Vixurious Designs (“we”, “us”, or “our”).

 

To use our services, you (“you” or “Client”) must agree to and abide by these Terms stated on this page. These Terms apply to all visitors, users, and others who operate on this website. By agreeing, you accept the terms listed below. In the event that you do not comply, you can no longer use our Services. 

 

1. Terms of Services Changes

 

We may update our Terms of Services from time to time. Therefore, we advise that Clients read these terms periodically or when notified of a change. The Creation date of the terms is provided at the top of this page and a date effective, that we will use as an update reference, is provided below. Any changes are effective immediately once posted to this page. 

 

2. Your Privacy Matters

 

We understand how crucial it is to protect your information. We’ve outlined the use of your Personal Information in our Privacy Policy, which provides Clients with the details about our Services and the collection of Personal Information. Please be aware that, in agreement of using our Services, Clients also agree to our Privacy Policy. For more information, click here

 

To Californian and EU Users, Visitors and Others associated with the operation of our services, please read the following in regard to privacy: 

 

For Californians, or clients/visitors/others in California, our Privacy Policy and other policies will be governed by the implemented laws of the state of California, and if issues were to arise, they’ll will be handled in accordance with the laws, including our disputes.

 

For EU clients/visitors/others, our Privacy Policy and other polices will be governed by the laws implemented by the EU. In the event that issues arise, they’ll be handled in accordance with EU laws, including our disputes. 

 

3. Your Use of Our Services

 

When accessing our services, there are a few rules Clients must follow: 

 

A. You must be over the age of 16 to access and order our services. 

 

We understand that, as the years go on, younger authors are continuing to establish themselves and will need the Services in which we provide. However, we reserve the right to only permit use of services to those above 16 to assure that our Clients are providing us with honest and permissible interactions and information. 

 

In the event that you are not of the require age, we ask that you no longer use our Services as stated in our Privacy Policy

 

B. Client Personal Accounts and the Use of Them

 

Clients have access to two different accounts (free and subscription based) if they have purchased our Annual Author Design plan via our website or if they desire to keep track of their commissions through a free account. These accounts hold your Personal Information such as your name, your email, your payment information and more outlined in our Privacy Policy

 

FREE AND SUBSCRIPTION PERSONAL ACCOUNT

 

Your free/subscription account will allow you to mainly keep track of ordered design commissions and save your payment information. However, we ask you to abide by the following rules when signing up:

 

  • Be honest about the information you are providing. You are prohibited to provide false information about others or another company, and proper action will be enacted if this is discovered. 

  • Provide both your legal name and author pen (if applicable). This helps us keep your information organized if you decide to remain a permanent Client of our Services. It’s optional to provide an author pen. Please make sure that the names you provide are appropriate. 

  • Know that you are responsible for your account. If you decide to share your account with others, you understand the risk and potential consequences of leaking your financial information out to others. We are not responsible for self-imposing issues like these but will do what we can to help you. Please also make sure to keep your password secure.

  • Our relationship with you. As a client, you maintain a client-designer relationship when interacting with our Services. Having an account with us does not grant you anything else but this relationship in use of our Services. 

 

C. Understand our Design Procedures

 

Your chosen designer has a strict design method/procedure they follow. Please refer to the Design procedure section for a simple overview of this process. There is a difference between subscription-based and non-subscription procedures. You are responsible for knowing the difference. 

 

4. Refund Policy and Design Fees

 

REFUND POLICY 

 

We maintain two different refund policies: full and partial. Please make sure you know the difference by reading the following:

 

FULL REFUND POLICY

 

You are allowed to issue a full refund request via our sales@vixuriousdesigns.com email and you will be refunded within 24-48 hours. Full refund requests will occur before within a 1–3-day window from the initial request. 

 

PARTIAL REFUND POLICY

 

Likewise with the Full Refund Policy, you are allowed to issue a partial refund request via our sales@vixuriousdesigns.com email and you will be refunded within 24-48 hours. Partial refund requests after the 1–3-day window from the initial request. You will receive 2/3 partial refund due to a Service fee applied. 

 

DESIGN FEES

 

With our Services, there is only one fee. You pay the flat rate depicted on the website for each service such as a premade, custom book cover design or custom boxset design. The only fee you will pay, if you decide the product does not meet your standard or whatever the circumstances may be, will be the Service fee. 

 

OUR SERVICE FEE IS ONLY APPLIED TO TRANSACTIONS THAT HAVE OCCURRED AFTER THE 1-3 DAY WINDOW AND SERVES AS A RETURN ON THE DESIGNER’S INVESTED TIME AND OTHER CHARGES SUCH AS STOCK FEES. 

 

FEES ARE SUBJECT TO CHANGE AT ANY TIME AND THE CLIENT IS RESPONSIBLE FOR KNOWING ABOUT THESE CHANGES. 

 

5. Termination

 

 A. Client Termination.

 

While we value your time with us, we understand that, if our Services no longer satisfy you or if there are other circumstances preventing you from continuing with us, you may terminate your account by sending in a request to info@vixuriousdesigns.com. Your account will be terminated within 24-48 hours upon receiving the request. 

 

This will not affect your orders or your ability to place orders with us or continue to purchase products from our website. 

 

B. Vixurious Designs Termination

 

If a Client is found in violation of our Terms of Services, we reserve the right to temporarily block your access to your account. This block will remain for 24 hours. In the event that you continue to violate our terms and show no signs of acting in accordance with them, your account will be terminated, and you will no longer be able to create an account with our Services. 

 

Depending on the offenses, there is a chance that you may be unable to continue placing orders with us or continuing to purchase from our website.
